Meeting Minutes
June 1, 2004
Attendees: Scott Hundley, Mark and Erin Summerfield, Ed
Heberg, Larry Goldfarb, Diane Wiltshire, Paul Thorman, Joe Fasching and Joel Prostick
Open: The first
portion of the meeting was held at the Shesue pipe stem.
The Chairman of the ARB, Larry Goldfarb, began the meeting at 7:05pm.
Lands and Grounds Report:
- It was brought to
our attention by a homeowner that the common area along Pensive near Shesue needs to be
mowed and branches trimmed. We looked over
the area and only found a few branches that needed trimming. Ed will bring this to the attention of Sunrise.
- We met at the
Shesue pipe stem to discuss creating a narrow pathway from Shesue Street into the common
area, so that homeowners would not use the private pipe stem as an egress into the common
area. Different areas to hold the Block
Party were discussed and also different pathways into the common area were also discussed. An offer of free mowing sessions by LEXHOA of the
common area was offered and a sign, clearly stating this pipe stem is a Private Road
no vehicles allowed or something similar was also discussed.

Open: The remainder
of the monthly LEXHOA meeting for June was held at the Summerfield home. The President, Scott Hundley, called the meeting
to order at 7:45pm.
Secretarys Report:
- The minutes of the
May 4 meeting were reviewed, edited and approved.
Treasurers Report:
- Received the legal
fee for the lien proceedings against the owner(s) of 10516 Brevity processed by Troutman
Sanders LLP.
- The Virginia
Nonstock Corporation Act requires an annual financial audit. Mark will look for a company or CPA who is
experienced in auditing community associations.
- 10412 Artemel and
10421 Artemel apparently are being sold and requests for disclosure packets have not been
received. Mark notified the Real Estate
Agents representing each home about the Virginia law requiring homeowners to supply this
disclosure packet to sellers. He hadnt
heard anything back, so Erin will call each homeowner and notify them of this Virginia
requirement.
- A resolution
policy was drafted in 2002, Troutman Sanders will be asked if they drew up this policy and
is it considered due process when handling complaints against homeowners.
Architectural Review Board:
- The ARB hasnt
had a response from 10522 Brevity per their request for tree removal nor regarding the
denial of the current house color. The ARB
will call the owners and inform them that due process will be started.
- 1086 Pensive has
submitted a second request with new drawings for an addition of a two-car garage. This request was also denied based on the frontage
of the design. The owners have requested
copies of all ARB correspondence. Per Article
10 of the Bylaws, the books, records, and papers of the Association are only subject to
inspection. The ARB hasnt heard back
regarding either of these issues.
- The ARB was told
that the owners of 10516 Brevity havent mown their lawn this season. A couple of days prior to this meeting, the lawn
was mown.
Lands and Grounds Report:
- Will request
estimates from Sunrise, Howard Landscapes and Westview Landscapes for clearing a path into
the common area near Shesue pipe stem.
- Ed will get two
more estimates from Sunrise and Westview Landscaping companies for the same work on the
west entrance and the new east entrance. Sissons
declined the job.
- Ed will get quotes
from all three companies above for a new path near the new east entrance.
- Ed will obtain a
quote from Sunrise for a once a year tree/shrub trimming along both sides of Pensive near
Shesue; the East side belongs to LEXHOA and the West side belongs to Fairfax County School
Board.

- See first portion
of meeting above.
Old Business:
- Erin retrieved the
signatures of the three homeowners who live on the Brevity and Challedon intersection to
sign either for or against the new stop signs. She
will speak with someone at Joan DuBois office for further instructions.
New Business:
- Dirt bike riders
were tearing up the common area between Brevity and Artemel. They also drove through and tore up one homeowners
garden. The homeowner requested some sort of
fence or gate and this was disapproved by the LEXHOA Board.
An email was sent to all homeowners concerning the matter, as motorized vehicles
are forbidden in common areas. The homeowner
was asked to report future violations to the police and to Erin. The violators will be prosecuted with
trespassing and vandalism.
